Fix-A-Lot Property Maintenance
The Contract
These terms apply to all services provided by Shaun Linsley trading as Fix-A-Lot Property Maintenance (“we”, “us”). By booking a service, you (“the Client”) agree to these terms.
Services Provided
We offer two distinct categories of service:
- Maintenance Services: Plumbing, minor electrical, handyman tasks, and general repairs.
- Professional Assessment Services: EPCs, Legionella Risk Assessments, Damp & Mould Assessments, PAT Testing, Fire Door Inspections, and Retrofit Advice.
Professional Fees & Payment
- General Maintenance: Invoices are issued upon completion and are due within 7 days.
- Assessment Services: For EPCs, Legionella, Damp & Mould, and Fire Door reports, payment is due before the final report is released or lodged on any national database.
- Deposits: For any project or repair exceeding £1,000, a 10% deposit is required before work commences.
- Late Payment: We reserve the right to charge interest on overdue invoices at a rate of 8% above the Bank of England base rate.
Cancellation & Cooling-Off Rights
- 14-Day Right to Cancel: Domestic clients have a legal right to cancel this contract within 14 days of the booking date without giving a reason.
- Emergency Works Exception: The 14-day cooling-off period does not apply to urgent repairs or maintenance (e.g., emergency plumbing) that you have specifically requested us to carry out immediately.
- Starting Work Early: If you request for non-emergency services to begin within the 14-day cooling-off period, you must provide this request in writing. If you subsequently cancel, you will be liable for the cost of the services provided up to the point of cancellation.
Limitations of Professional Assessments
- Access: Assessments (EPC, Fire Door, etc.) are based on a non-invasive visual inspection of accessible areas only. We are not liable for defects in areas that were concealed, locked, or otherwise inaccessible at the time of inspection.
- Information Accuracy: Our advice (specifically Retrofit Advice) is based on the information provided by the Client. We are not liable for financial losses resulting from inaccurate data provided to us.
- Third-Party Use: Reports are prepared solely for the named Client. We accept no liability to third parties (such as potential property buyers) who rely on the report without our express written consent.
Insurance & Liability
- Public Liability: We maintain Public Liability Insurance up to £2,000,000 for physical damage or injury.
- Professional Indemnity: We maintain Professional Indemnity Insurance to a minimum of £500,000 to cover our professional advisory, inspection, and assessment services.
- Extent of Liability: Our total liability for any claim shall not exceed the limit of our relevant insurance policy. We are not liable for pre-existing structural defects or “Acts of God.”
Complaints
If you are unhappy with our service, please refer to our Complaints Procedure page. For EPC and Assessment services, disputes can be escalated to Elmhurst Energy (Assessor ID: EES/035057) if they remain unresolved.
